Terms & Conditions
These terms govern your use of Mulberry Sales, a subscription software service for FMCG distributors and traders. By creating a workspace, signing in, or paying for a plan, you agree to them.

1. Who you are contracting with
Mulberry Sales ("Mulberry Sales", "we", "us") is operated by Sahaya George Ashinth A, constituted as an individual (not a registered company or partnership), with its registered place of business at 32A/12, Salate Matha Street, Thalavaipuram, Nagercoil, Kanyakumari District, Tamil Nadu 629004.
"You" means the business that subscribes to the service, and each person you authorise to use it — owners, administrators, salesmen and any other staff you add to your workspace. You are responsible for what those people do with the service.
2. What the service is
Mulberry Sales is hosted software (SaaS) for running a distribution business: counter and van billing, stock and inventories (a stock point is called an "inventory"), purchases, day-lists and beats, salesman attendance and location tracking, collections, damage write-offs, and day-end and profit reporting. It is delivered as a web console and a companion mobile app.
Nothing physical is sold or shipped. There is no delivery of goods, and no product is dispatched to you — access to the service is provisioned to your workspace immediately on successful payment.
The service is intended for business use in India only. It is not sold to consumers for personal use.
3. Accounts and access
- You must give accurate business details when you register, and keep them current.
- You are responsible for keeping login credentials and OTP codes confidential, and for every action taken under your workspace's accounts.
- Tell us promptly if you believe an account has been compromised.
- We may suspend an account that is being used to break these terms, to break the law, or in a way that threatens the security or stability of the service.
4. Trials, plans and limits
New workspaces get a free trial of 14 days with no card required. When the trial ends you must choose a paid plan to continue using the workspace.
Each plan sets limits — for example the number of salesmen, inventories and vehicles — and unlocks a defined set of features. Current plans, prices and limits are published on our pricing page. Attempting to exceed a plan limit will be blocked in the software rather than billed as an overage.
We may add, rename or change the composition of plans. If a change materially reduces what your current plan includes, we will tell you before it takes effect for your workspace.
5. Fees and payment
- All prices are in Indian Rupees. We are not registered for GST, so no tax is added at checkout and none is collected from you. An invoice is issued for every successful payment.
- Subscriptions are billed in advance, monthly or annually, for the period you select. Annual plans are billed as ten months' price for twelve months of service.
- Payments are collected online through our payment gateway, Razorpay. We do not receive or store your full card, UPI or net-banking credentials.
- If you change tier mid-cycle, the unused value of your current period is carried across as a credit against the new plan, so the same days are not paid for twice.
- If a renewal payment fails, your workspace continues to work for a grace period of 7 days. If it is still unpaid after that, the workspace is suspended until payment is made.
- We may revise our prices. A price change never applies to a period you have already paid for, and we will give notice before it applies to your renewal.
6. Cancellation and refunds
You may cancel at any time; cancellation stops future renewals and your workspace stays usable until the end of the period you have paid for. What we can and cannot refund is set out in full in our Refund & Cancellation Policy, which forms part of these terms.
7. Your data
The business data you put into Mulberry Sales — your products, shops, customers, bills, stock and staff records — belongs to you. We process it to run the service for you, as described in our Privacy Policy.
You can export your data from the workspace at any time while your subscription is active. You are responsible for the lawfulness of the personal data you upload about your own staff and customers, including telling them what you collect and getting any consent that the law requires — particularly for location tracking of field staff.
8. Acceptable use
You must not, and must not allow anyone else to:
- use the service to break any law, or to store or transmit unlawful content;
- resell, sublicense or provide the service to a third party as your own product, unless we have agreed to that in writing;
- copy, decompile, reverse-engineer or attempt to derive the source code of the software;
- probe, scan or test the security of the service, or interfere with its normal operation;
- upload malware, or attempt to access another customer's workspace or data.
9. Availability and support
We aim to keep the service available continuously, but we do not promise uninterrupted or error-free operation. Planned maintenance, third-party outages (hosting, payment gateway, mobile networks) and events outside our reasonable control can interrupt access. A specific uptime commitment applies only where an Enterprise agreement says so in writing.

10. Intellectual property
The software, its design, and all related material are owned by us and are licensed, not sold. Your subscription grants a non-exclusive, non-transferable right to use the service for your own business for as long as your subscription is active. All rights not expressly granted are reserved.
11. Liability
The service is provided on an "as is" basis. To the maximum extent permitted by law, we are not liable for indirect or consequential loss, or for loss of profit, revenue, goodwill or anticipated savings.
Our total liability arising out of or in connection with the service, in any twelve-month period, is limited to the subscription fees you actually paid us for that period. Nothing in these terms excludes liability that cannot lawfully be excluded, including for fraud.
You remain responsible for your own statutory compliance — GST returns, invoicing accuracy, employment and labour law — and for verifying the figures the software produces before you rely on them for a filing.
12. Suspension and termination
- You may stop using the service and cancel your subscription at any time from within the workspace or by writing to us.
- We may suspend the workspace for non-payment after the 7-day grace period, or immediately for a serious breach of these terms or a security threat.
- After termination we retain your workspace data for 60 days so you can reactivate or export it, after which it may be deleted permanently.
13. Changes to these terms
We may update these terms as the product and the law change. The current version is always published on this page with its "last updated" date. Where a change materially affects your rights, we will notify workspace owners before it takes effect. Continuing to use the service after that means you accept the updated terms.
14. Governing law and disputes
These terms are governed by the laws of India. The courts at Nagercoil, Tamil Nadu have exclusive jurisdiction over any dispute. Before starting proceedings, please contact us so we can try to resolve the matter directly.
